Customarily, courts will sanction parties that fail to disclose documents (in this case Nevada County and Diaz) by forcing them to pay the legal fees of the the other party. Sanctions are rare and only ordered by a judge in the most egregious circumstances.

The County network is state of the art, with sophisticated back up systems. How come the County IT team could not find the requested electronic documents? Unless those documents are the smoking gun as to had access to the intellectual property in question and when, and the County does not want the access records found. This is getting to be a real mess and could really damage the reputation of our local county government. I suggest they do a little risk assessment and come clean real soon now.

Last week, the county and Diaz requested the federal judge to reconsider the magistrate's order. Yesterday, the judge denied the request.

When I read about this from the beginning it sounded from a laymans perspective the county was guilty, that does not always mean anything in the world of law. Sounds like like they got an excellent judge for this case though. As Russ pointed out and the salaries that I saw awhile back this place shouldn't have piles of papers stored in cardboard boxs someplace.

Here's another tip for your "gumshoe" reporting: Go back to the last BOS meeting, and you'll see some mention of this case.

BTW, speaking of "censorship," why is there no reporting from this group about the documents alleging voter intimidation in Truckee? Double standard?

In fact, Barry, those poll watchers who were accused of the intimidation and disruption up there weren't "retired old ladies" as you said after all, were they? LOL forever on that one!

I know you're not the sharpest tool in the shed but follow me S-L-O-W-L-Y:
The extreme right blogs — Barry and Russ — jumped down the county's throat, making fun of the Other Voices column about voter intimidation. Barry wrote that the county was whining about "retired ladies." Russ was also insulting.
Only as it turns out, when more documents were released, the poll watchers who were accused of intimidation and disruption weren't "retired ladies" at all — they were much younger people involved with the McClintock campaign. Barry to fill you in on more details over your "pina colotas." (Your spelling).

No follow up, though, from the extreme right blogs. The silence was deafening. LOL.

Jeff, thank you again for the signature way that you were able to point out this correction. And I also appreciate the "gumshoe reporting" tips. Am not sure whether these derive from your arms-length journalistic studies, or from current practice.

Yes, please do not go down Pelline's bunny trail. Let's focus, we know about the 20K in fees, but what is the independent council going to cost the County? This is going to be huge $$$ sink hole before it is all over, unless the BOS realize they were bamboozled into supporting Diaz and cut their losses. Stay Tuned.

When Green won the Assessor post in 1998 he was caught paying a contractor a million bucks to do software which never came to pass. After GJ investigation it was revealed Green was paying people who owed him money and this crook was using our tax money to get paid back. I had actually given the info to Seelmeyer way before the election who chose to ignore it. After six months Green resigned under threat of prosecution.

I had a long and stormy relationship with him. He ran articles made from whole cloth about me and people I debated and he was not her. He, like other liberals, did not like conservatives. He used the excuse it was political drama but he had the info from others besides me. He was also a buddy of Greens.

I did some research about the magistrate.

Judge Kimberly J. Mueller is currently a United States Magistrate Judge for the Eastern District of California, a position she has held since 2003.

On March 10, 2010, Magistrate Mueller was nominated by President Obama to sit on the bench as a judge of the Eastern District of California.

“I am honored to put forward these highly qualified candidates for the federal bench,” President Obama said. “They will be distinguished public servants and valuable additions to the United States District Court.”

Previously, Magistrate Mueller was in private practice specializing in intellectual property work, first as an associate attorney with Orrick, Herrington & Sutcliffe LLP and then as a sole practitioner in Sacramento. Judge Mueller has taught as an adjunct faculty member at Pacific McGeorge School of Law and at the U.C. Davis School of Law. Prior to earning her J.D. from Stanford Law School in 1995, Mueller served a five-year term on the Sacramento City Council and was Health and Safety Director of the California Firefighter Foundation.

Seems pretty knowledgeable about the type of law involved in the case.

They are still fighting. The County and Diaz provided some of the records but not all as required by the court order. Another ruling should be coming from the magistrate in the near future.
