Compliant Comey exonerates Hillary

This morning we heard FBI Director James Comey announce that the bureau’s exhaustive investigation found no reason to bring criminal charges against Hillary Clinton regarding the goings on with her private email servers when she was Secretary of State.

His conclusion was based on two factors –

1. Lack of intent to harm the country. “Although we did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless in their handling of very sensitive, highly classified information,”

2. Assessing the success of a subsequent prosecution were she indicted; to wit, “no reasonable prosecutor would bring such a case.”

Anyone who has ever held high security clearances with the responsibility to safeguard classified materials, and also the responsibility to classify previously unclassified materials knows that intent to violate the laws governing such handlings makes no exception for the perpetrator’s intentions.  (cf Federal Penal Code, Title 18, Sec 794(f)(g) ) It is the existential behaviors and their portent for harm that determine guilt or innocence.  Without doubt Hillary’s position as SecState assigned her those responsibilities, apparently without having to be accountable for failing to carry them out.  When I was in government service, holding such high clearances in and out of the military, any careless, let alone “extremely careless”, handling of classified materials would have instantly resulted in the loss of my clearances and a criminal indictment.  Were this to have happened while I was on active duty, I would have spent my life in Leavenworth no matter what my intentions had been.

And when did it become a material factor for a criminal investigative agency to base its findings on its own apprehension of what every one of the population of the country’s “reasonable prosecutors” would do were the conclusion to recommend indictment?  In this case that decision is specifically reserved for the DoJ of which AG Lynch in her recent half-hearted retreat still retained her right to make the final decision to indict or not.  Comey’s precipitous conclusion and rationale relieved Team Obama of having to bear the corruption-laden political brunt of exonerating Hillary.  Comey conveniently chose to fall on that sword himself.

According to my lights it is beyond ludicrous to conclude that “no reasonable prosecutor” could be found to prosecute Hillary based just on the evidence that has been released to, and surreptitiously withheld from, the public.  The most likely case is that there would be tens of reasonable prosecutors across the country who would step up to make the case that Hillary is guilty of a long list of serious infractions that include impeding the investigation.

Finally, we are being asked to believe that the sequence of recent events had no impact on the investigation’s outcome and its timely announcement this morning.  We are asked to believe that all parties and departments for the first time in federal government history behaved with solid insularity between jurisdictions, with hundreds of agents, bureaucrats, and officials remaining mum about their individual goings on.

Exit questions: How would Hillary’s announced trip with President Obama on Air Force One to campaign in North Carolina have had to be handled if Comey had recommended indictment?  Without certain knowledge of Comey’s compliance as a team player, who would have had the meetings, scheduled the events, and made the public statements we have witnessed in the last week?  Is it really over?

In my Air Force career and management position with a Department of Defence contractor I participated in multiple highly classified programs. If anyone participating in these programs was as sloppy in handling classified material as Hillary Clinton and her staff did they would be charged, brought to trial and most likely put in jail. Some were for doing far less that Hillary and her staff did. Just take Comey's words and replace the Clinton references with a non-political person and ask yourself, would the FBI have recommended no charges for willful disregard of the national security of our nation, or not?

Hillary was not cleared today. She was not charged. The FBI statements are indeed damning. Gross negligence proven beyond any shadow of doubt. State secrets were put at risk. Whether the unauthorized setup was for convience or to avoid FOIA, the investigation proved beyond any reasonable doubt that My Gal's talking points were a lie, no matter how carefully she worded "I have not received or send any e-mails marked classified." FBI today said "no way, Jose." Now this moves into the political realm, which means the court of public opinion. Only poll that matters is the ballot box.

Bottom line: if Hilary were to apply for security clearance today, the FBI would deny the security clearance request, hands down. Lest we forget.

Today, the FBI sold out the Rule of Law in America. After describing clear evidence of extensive mishandling of classified national security information, FBI Director James Comey announced that the FBI will not recommend indicting former secretary of state Hillary Clinton. This is naked crony government, ugly and exposed. Comey’s decision will go down as one of the government’s worst assaults on truth in its War on Honesty.

Today’s press conference was, in many respects, an exercise in legal and cognitive dissonance. Comey acknowledged Clinton sent and received Top Secret emails that “any reasonable person” understands not to discuss on an unclassified system.

Red flags? Excuse me, sir—that’s a crime.

Comey also acknowledged her email system was housed on unclassified personal servers that lacked full time security systems. Indeed, nations and groups hostile to the U.S. could have hacked the system. Comey acknowledged “hostile actors” hacked individuals corresponding with Clinton on her unauthorized system. She also used her unsecured personal system outside of the U.S.—in places where sophisticated adversaries could hack her communications.

Comey called this careless. Sir, it is reprehensible. It is reckless disregard of American security.

Then he said he would not recommend indictment.

This is beyond outrage. Everyone who has carried a Top Secret clearance and had access to Top Secret information knows that Clinton has criminally violated the laws protecting classified information. These laws serve a purpose. Protecting security secrets is essential to protecting America.

The courts may provide some succour to us who seek the truth about what went on. The lawsuits prying open info from govt agencies are proceeding and even the State Dept may find enough type writers to push out some damning evidence provided enough paper is budgeted for. Exonerate is, for now, a proper term for what she faces criminally. There is still the court of public opinion and legion are the lefties and Clintonites who will not show their faces nor appear in public to try to take the law's side in this matter.
It is just possible, just possible, that at some point some of the most ardent and fervent supporters of Hillary will grow weary of providing cover for her and her misdeeds.

It really isn't exoneration... just a recommendation to not prosecute. Many violations of the statutes but no criminal intent. The curious thing is that Comey also made it clear that others have been and will be subject to those statutes, and what he didn't make clear is that they don't require criminal intent. All it takes is gross negligence in handling classified material, in Hillary's case the material handled with gross negligence ranged from Confidential to Top Secret... by the classifications they were given at the time.

If Trump can't win with this windfall of campaign material, he really doesn't deserve the office.

Letting Hillary skate today is no surprise when the team she's on has celebrated its administrators pleading the fifth, over and over again, sending messages to America that they're all above the law. Like the IRS and the Secret Service, more and more of the federal government is no longer trustworthy or competent.

“I’d rather have a sister in a whorehouse than a brother in the FBI.” That quote from the Alabama Securities Commissioner appeared on the front page of the Wall Street Journal in 1980, referencing the feds’ unwillingness to go after financial criminals. But it’s a sentiment that may be shared by a lot of people given the FBI’s recent record.

Bureau Director James Comey’s press conference, in which he laid out an extended record of misconduct by Hillary Clinton, but then announced that he wouldn’t recommend prosecuting her, was just the latest in a series of very visible FBI failures.

The FBI had interviewed deceased Boston Marathon bomber Tamerlan Tsarnaev, after being warned by the Russian government that he was a threat, but still did nothing. Three people were killed and more than 260 were injured as a result. The FBI also investigated in advance, but failed to prevent mass shootings by Fort Hood mass shooter Nidal Hassan and Arkansas shooter Carlos Bledsoe.

The FBI made a ”mistake” in the background check for Charleston mass shooter Dylann Roof. As the Washington Post reported, “Comey said Roof should have been prevented from buying the .45-caliber weapon used in the shooting, which authorities have said was motivated by Roof’s racist views. The political repercussions of the June 17 massacre at Emanuel African Methodist Episcopal Church in Charleston led South Carolina to remove the Confederate flag from its statehouse grounds Friday.” Said Comey, “The thought that an error on our part is connected to this guy’s purchase of a gun that he used to slaughter these good people is very painful to us.”

It was also painful to the families of the 9 people who were killed.

IF they were able to get into the Presidential Debates I'm guessing they would pull around 30% and the dialogue would be great. Regarding the snipe over Republicans and their "moral values", this is the sort of misuse of the language and the truth that helped me out of the Democratic Party... Republicans never, to my reckoning, ever put themselves on a moral pedestal. What I heard them selling is their intent to craft laws and a government that supports people that intend such a life. Family values being one that helps, not hinders, parents wishing to impart to their children a sense of judeo-christian ethics as supported by the dominant religions practiced in the USA.

For example... the Boy Scouts of America. Currently a whipping boy. My late first wife's family was active in the BSA, my son's uncle was (is?) an Eagle Scout, now a bigwig in the California Park Service. She introduced our son into scouting early (Tiger Cubs) and he stayed with it, eventually earning the Eagle rank. I supported his scouting after his mom passed away but I never joined as an adult as there were elements of the pledge I would have had to take that I could not accept. No problem, my first wife did, my son did.

That never kept me from supporting what his troop did, or supporting his scoutmaster (the retiring Bob Triberg who was in the paper recently) when he needed my help.

Imagine my disgust when Democrats attending a party convention booed the scouts (lets remember these were *children*) volunteering to serve as color guards, because the *private* group had chosen to bar gay adult leaders, believing heterosexual adults were the role models the group wanted for their boys. No, while I'd not personally object to being around "Big Gay Al" (a South Park gay character active in scouting), I'd have preferred not to have Big Gay Al being an adult leader in my kid's troop... not because I wanted my kid to hate gays, but because I wanted him to learn how to be an ethical heterosexual man, learning by example, and that has been a feature of scouting since the beginning.
