Barr sent the memo while he was in private practice and months before he was selected by Trump for the top Justice Department job. On Tuesday, Barr will seek to assure lawmakers that the memo was narrowly focused on a single theory of obstruction that media reports suggested Mueller might be considering, according to a copy of his prepared remarks provided by the Justice Department.
Barr is expected to tell senators he wrote it himself as a former attorney general "who has often weighed in on legal issues of public importance."
As part of his testimony, Barr is also expected to tell the senators that Trump didn't seek any assurances or promises before nominating him.
In the memo, Barr argues that it could be disastrous for the presidency and the Justice Department if Mueller concludes that actions the president is legally permitted to take — including firing an FBI director or granting a pardon — could constitute obstruction because of a subjective determination that they were done with corrupt intent.
Barr acknowledged a president can commit obstruction of justice by destroying evidence or tampering with witnesses. But, he said, he wasn't aware of any accusation like that in Mueller's investigation.

Why would the president's AG nominee William Barr telegraph the preposterous statement that he will tell the Senate judiciary committee that he would unconditionally allow Mueller to finish whatever he's been doing in the attempt to bring down the administration?


A statement for primarily for public consumption! Every candidate is going to be accused of wanting to end the investigation on purely political grounds! Your fellow citizens…….mostly morons (See Punchys 6:12pm) need to be reassured that nothing untoward will result from Barrs appointment!

The latest Quinnipiac University Poll finds that the majority of Americans, Republican voters, swing-voters, American men, as well as both college-educated whites and non-college educated whites agree that there is a “security crisis” at the southern border.

Every party, gender, education, age and racial group supports this idea except Republicans, who are opposed 52 - 39 percent.

Voters oppose 63 - 32 percent shutting down the government to force funding for the Wall, the independent Quinnipiac (KWIN-uh-pe-ack) University National Poll finds. Again, Republicans are the only listed group supporting the shutdown, 67 - 24 percent.

The GOP is losing the battle as 56 percent of American voters say President Donald Trump and Republicans in Congress are responsible for the shutdown, while 36 percent say Democrats are responsible.

Voters remain solidly opposed to a wall on the Mexican border, 55 - 43 percent, and reject every argument for the Wall. The 55 - 43 percent opposition compares to 54 - 43 percent opposition in a December 18 survey, just before the partial government shutdown.

Well the Repubs neutered Trump by picking up 40 seats in the House so they can tee off on him at will for the next two years. Pretty much on schedule. It takes a couple of election cycles to regain control and the Dems are right on schedule. Interesting developing story. Under the category “Let’s wait until this unfolds.” John Solemon has written some excellent articles and has done some great in-depth reporting. New ways to spy on journalists? Where are the civil libertarians now?

“Rosenstein’s effort, whether successful or not, is certain to foster a debate.

I, for one, have a special vantage point molded by personal experience.

As an investigative journalist for The Associated Press at the start of George W. Bush’s administration, the Justice Department and then-Deputy Attorney General Robert Mueller — yes, the same one now running the Russia investigation — subpoenaed my phone records without notifying AP.

Justice then took special steps to delay notifying me for months, a delay that allowed Mueller’s nomination as FBI director to be confirmed by the Senate before lawmakers could learn of the intrusion on my First Amendment-protected reporting.

There was an outcry, but it didn’t stop Justice from further intrusion. A few months after seizing my phone records without the normal notification, the DOJ went a step further and seized my personal mail through the FBI, where Mueller was then the boss.

This time, they didn’t use a subpoena or a warrant. They used an archaic legal concept known as “border-search authority” to open a package coming from the Philippines that included a legacy FBI lab report sent to me by a source.

The report was neither classified nor deemed sensitive. It simply was embarrassing to the FBI because it showed the bureau was aware of al Qaeda terrorist plots targeting airliners well before the 9/11 attacks.

After finding the report, the FBI kept the document from me without seeking a warrant or subpoena — a clear, unequivocal violation of my Fourth Amendment protections against illegal search and seizure.

When my package didn’t arrive, I became suspicious and eventually proved that the FBI had confiscated it illegally. When confronted, the FBI admitted it had engaged in wrongdoing and the bureau, DOJ and AP lawyers worked together to put rules in place to avoid the type of abuses to which I’d been subjected.

My case showed that, even with rules in place, the DOJ and FBI had the means, motive and will to trample on the First Amendment rights of a free press. Furthermore, I saw the chilling effect that government intrusion had on my work: Well-intentioned sources were afraid to talk to me or to meet, for fear they would be caught in a dragnet.

It took months, years, to recover from that harm.

Consequently, Weissmann will likely remain Mueller’s “pit bull,” because without the missing documents prompting a public outcry, nothing is likely to change—especially since Mueller led the FBI at the time of the Enron prosecutions and was surely well aware of Weissmann’s modus operandi when he brought him on board as his lead prosecutor. It is facts like these that lead many on the right to question the integrity of the special counsel probe.“

That is the problem with the Deep State. Every democracy and parliamentary system under the sun, past, present, and future can fall prey to the Police State. When found out that prosecutors withheld Exculpatory evidence from the defense, witness tampered and threatened witnesses, lied to the Court, filed false documents and “evidence”....well, the few times a incredulous judge sanctioned the prosecutors for such unlawful and illegal behavior, the Federal prosecutors have received the severe penalty of a 1day sanction (one day), and in one flagrant example, a member of the Police State received a 30 sanction, allthewhile receiving his paycheck, keeping his job, and receiving no in-house reprimands or ding on his file. No consequences. It’s what our founders warned us about....to fear our government because governments by their innate nature have an insatiable hunger for more power, more reach, more, more, more.....and more f everything to be brought under their control. RCP Average of the Congressionals showed the Dems with an 8% edge with the exception of
Rasmussen which gave the Repubs a 1% edge. That's actually 9%.. Rasmussen has now joined the pack expressing negative Trump job numbers of double digits. RCP Average is 14.5% negative Rasmussen is 12% negative. I'm wondering why Rasmussen is now part of the pack when before they were out on their own path.
