For those who have been following the Norway story, she lost her government as predicted.


The problem is that it may be difficult to convict ISIS fighters under the exacting standards that apply in criminal cases. Moreover, judges in countries like Norway may be sympathetic to the defendants, just as portions of the American legal community were sympathetic to al Qaeda terrorists and suspected terrorists.

That’s why, according to one expert quoted by the Post, “even people who are usually quite liberal on immigration issues [opposed] Norwegian authorities helping [the ISIS woman] to get back to Norway.” One might have thought that President Trump, who isn’t usually quite liberal on immigration issues, would have more sympathy for this sentiment.

In any case, the Norwegian prime minister’s loss of her majority sends a warning to other European leaders who are under pressure to repatriate ISIS fighters. The pressure doesn’t come in just one direction. There is political pressure coming from the opposite direction.

Bloomberg) -- The U.S. Supreme Court signaled it won’t take up appeals defending Obamacare during the term that ends in June, rejecting requests by Democratic-led states and the House to put the case on a fast track.

The appeals, filed separately by the House and a California-led group of 20 states plus the District of Columbia, urge the court to issue a definitive ruling upholding Obamacare. A federal appeals court decision last month found a key piece of the original 2010 law unconstitutional and raised questions about the rest of it.

The lawmakers and states asked the justices to consider their bids for review on an expedited basis and then to schedule arguments either for late April or during a special session in May. That would have meant a ruling well before the November election.

Bernstein added that Trump has been appointing very young judges.

"We have to pick a great one, we have to pick one that's going to be there for 40 years, 45 years," Trump said during a 2018 rally. "We need intellect, we need -- so many things."
Bernstein noted that the judges fit the mold of conservative legal philosophy broadly.

“I think there was a fear in some circles that Trump would appoint cronies and hacks. Hasn't happened,” he said.

“They’re very distinctly originalist judges,” McGinnis said. “They’ll follow precedent -- but when there isn’t clear precedent, they will look at the original meaning of the Constitution.
