If the seat is filled before the election, there will not be a record tunout of Democrats. Dems may collapse.

Well, if nothing else, Joe Biden will catch another break. All the attention will be on arguing about wait or not, have Scotus hearings in the Senate or not to have hearings, old quotes from Biden himself.....while Joe escapes the attention and spotlight. Man, it’s that guy lucky or not? He dodged another bullet. And that’s no malarkey.

Did find Chucky Schumer’s tweet somewhat puzzling. No vote until we have a new President? But, but, but I don’t think our nation can hold off until 2024. We need a fully seated Supreme Court. It’s one of the three branches of government Punchy told us and I can’t imagine our country going 4 more years without a full court. It would hurt trust in our institutions.

ooh. lots of wikipedia edits today for Judge Barrett. It's starting.

Bill Tozer

“It’s starting.” Not much for them to do. Trump, unlike Biden, has put out his list of candidates for public consumption many many moons ago. Every one on the list or not on the list but rumored to be under consideration already has had mega megabucks negative research on each one of them. The Dossiers have been completed years ago, (with the occasional updates) and all they need to do now is to blow some dust off the files— exactly like the Obama Administration did as soon as soon as they heard that Manafort might be considered for the volunteer unpaid Trump Campaign Manager.....but I digress.

If they can turn Brett Kavanaugh into some monster heartless teen age rapist ring leader in high school, just imagine what we can expect next. I believe it will be blatantly transparent. Wonder who the next Great White Hope Michael Avenatti will be? Bet he or she gets featured over 110 times on CNN within a 60 day timespan. Then we will know.

But it’s those wild stories that I live for.. ‘Children, please leave the room’ warnings wild.
Wonder what those Hollywood script writers will come up with next. Only limited by one’s imagination. Wasn’t Ben Rhodes a Hollywood script writer before he jumped straight over to Team Obama? Go directly to WH, do not pass Go. By Golly, he was. From Hollywood to top aide. Peddled some real good ones over in the White House.
Did like how Rhodes told NY Mag that the press today doesn’t know anything about the world around them, believe everything you tell them, airheads. He basically said the Press he met are just a bunch of young college kids about 26 who recently had followed some campaign and that’s all the journalism experience they have. Now they are covering WH Policy, lol. Yum, yum.

The Steele Dossier script (with obvious name and place corrections to reflex current times) can be found as written peddled in 2008 to Hillary Clinton to go after Obama....by one Glen Simpson. Great script. Hillary said she didn’t need it against Barrack, being the Chosen One and all.

Lay those good ear twitching stories on me.

Here is why -

Graham, who posted his comments to Twitter on Saturday afternoon, said that his decision to back President Trump was driven by two factors — former Sen. Harry Reid’s (D-NV) judicial confirmation rule changes and the Democrats’ ultimately unsuccessful attempt to derail Supreme Court Justice Brett Kavanugh’s nomination to the high court.

“The two biggest changes regarding the Senate and judicial confirmations that have occurred in the last decade have come from Democrats,” Graham wrote. “In light of these two events, I will support President @realDonaldTrump in any effort to move forward regarding the recent vacancy created by the passing of Justice Ginsburg.”

Well at least Lindsey Graham won't support a appointing a new Justice til the election is over. He can't be more specific than this:

https://www.businessinsider.com/lindsey-graham-2016-vacancies-should-not-be-filled-election-years-2020-9

And here:

"I'll tell you this – this may make you feel better, but I really don't care – if an opening comes in the last year of President Trump's term, and the primary process has started, we'll wait until the next election," Graham said during a forum with The Atlantic. His comments came at the tail end of the confirmation process for Trump's most recent Supreme Court pick, Justice Brett Kavanaugh.

Regarding RBG's desire to not be replaced by the current President... I'm surprised that she'd make that request known to her granddaughter, who is also a lawyer. RBG had every opportunity to resign during the Obama years when she could have been replaced by a 'friendly'... and she took a risk that Trump would beat Hillary C. in 2016. Who knows, after her bench buddy Antonin passed away, she might have been able to swing a deal to get Garland a hearing if she'd resign then, but she didn't, preferring to roll the die and hope to live until Jan 2021.

That didn't work out. Oh well, lesson learned. It won't help RBG secure a legacy more to her liking, but maybe Justice Thomas will take heed...

WHAT IT ALL COMES DOWN TO
“In the coming weeks, as the struggle to confirm a Supreme Court nominee fires up, we will be inundated with facts about past confirmation timetables and other “precedents.” Advocates will try to elevate past practices to matters of principle, and maybe even to matters of morality.

I think all of these arguments should be ignored. The only rule that applies, and it’s a reasonable one, is that Supreme Court nominees get confirmed when the president’s party has secured enough support from the electorate to muster the 50 Senate votes needed to confirm.

Voters didn’t give Democrats enough Senate votes to confirm Merrick Garland (or to get him the waste of time a hearing would have amounted to). That’s all there was to that story.”

How low can Trump go??? Here's a new threshold of scum from our Liar in Chief'

"Just days before Supreme Court Justice Ruth Bader Ginsburg’s death last Friday, she dictated a note to her granddaughter saying her “most fervent wish is that I will not be replaced until a new president is installed.” Several Republicans, eager to fill her now-vacant seat, dismissed Ginsburg’s request the same night as her death, and on Monday President Donald Trump was trying to allege that the justice never made the request at all.

https://www.huffpost.com/entry/trump-spreads-disinformation-about-justice-ruth-bader-ginsburgs-dying-wish_n_5f68c341c5b6480e8972af1f

During a Fox News interview Monday morning, Trump baselessly claimed Ginsburg’s request, first reported by NPR, was actually written by Democratic politicians. In reality, Ginsburg herself relayed the statement to her granddaughter, Clara Spera, NPR reported.

“I don’t know that she said that. Or was that written out by Adam Schiff, and Schumer, and Pelosi?” Trump asked. “That came out of the wind. It sounds so beautiful but that sounds like a Schumer deal,” he added. There is no evidence to support Trump’s accusation that California Rep. Adam Schiff, Senate Minority Leader Chuck Schumer or House Speaker Nancy Pelosi were involved in ghostwriting a posthumous plea from a deceased Supreme Court justice.

Oh, so we have to follow RBG’s wishes? Until when? Are you nuts?
WTF, that statement is ridiculous. RBG acted like she owns the SCOTUS seat, not rented and appointed to her by the electorate. RBG has no say in the matter. Whether it [her statements] is reflects her wishes or not, they have zero bearing on the process. The American electorate put in place a majority of Republican Senators to confirm or deny the President’s nominees for SCOTUS. Blame the American voter for turning the US Senate red, not blue. “We the people” have spoken by choosing senators in each of the 50 states. It’s not ‘We the RBG Wishes’.

RBG’s wish was to make it to and through to Jan 2017 by saving “her seat”. Didn’t wish and plan didn’t work out either.

Lol. Your assertions, Paul, do not pass the smell test.

Gregory

And RBG should have known that once dead, her ability to negotiate terms would end.

If it was so important to her to not be the cause of a 6-3 slant towards conservatives on the court, she should have resigned when there was a Democrat president.

Todd Juvinall

Only two requirements in the Constitution dealing with a vacancy. Only two. One, President nominates, Two, Senate advises and consent/vote. That's all folks. So how silly do the demoncrats look when telling th country Trump is doing something unconstitutional? Cracks me up. And John Paul Stevens was confirmed in 19 days. RGB in 42!

George Rebane

ToddJ 423pm - For the Democrats to tell the country that installing RBG's successor before the election is unconsitutional vies for the biggest Big Lie they have told this year, and given the Big Lies already in the archive, this is a real big one because it fools the mentally disabled who are more prone to believe the Dems imitation of authority.

He was the sole GOP senator to vote to oust the president. Now he must decide whether to stand with his party on an explosive fight for the high court.

All that remains are the crazy distortions, lies, and outright nonsense that the Blue Senators cook up in the hearing. Let 'er rip. All hands on deck for the character assassination.

Anyone who makes it through that deserves the gig. Expect thousands of articles on the 'People of Praise' as long as Barrett is in the running. Can't be havin' any Christians on the court after all.

Gregory: "If it was so important to her to not be the cause of a 6-3 slant towards conservatives on the court, she should have resigned when there was a Democrat president. "

Well, that might make sense. Of course you wouldn't get the fun of her granddaughter the hyperliberal lawyer getting to be on TV. Anything for a million hits on that post after all.

The funny thing about all the fuss is that you'd think that the Supreme Court is where you'd actually want the conservatives, assuming that they be given a voice at all. The House can make up a nutty law that violates the Constitution, the Supremes can reel it in. The country staggers along to the next 'emergency', accreting an ever-larger rule set bit by bit.

Of course we are living in crazy times. The US Democratic party has been taken over by mentally ill college students, thrown away the working class, is in bed with the part of large business that doesn't actually make things of value. Until that bunch worms it's way down the alimentary tract of the political class and pops out the other end, all bets are off

Mitt Romney's statement:

My decision regarding a Supreme Court nomination is not the result of a subjective test of ‘fairness’ which, like beauty, is in the eye of the beholder. It is based on the immutable fairness of following the law, which in this case is the Constitution and precedent. The historical precedent of election year nominations is that the Senate generally does not confirm an opposing party’s nominee but does confirm a nominee of its own.

The Constitution gives the President the power to nominate and the Senate the authority to provide advice and consent on Supreme Court nominees. Accordingly, I intend to follow the Constitution and precedent in considering the President’s nominee. If the nominee reaches the Senate floor, I intend to vote based upon their qualifications.

Scott O

BT 10:02 - Does anyone realize how sad it is for a sitting senator to rationalize his actions with an entire paragraph that has nothing more to say than - "I'll just do what the Constitution says we should do"?
Does Romney telephone the Utah State Patrol to let them know he intends to drive down the highway at the posted speed limit?
He is signalling that the left calls the shots and we conservatives need to constantly justify our actions to them.
What a gutless weenie.
I'd tell anyone who challenges my actions to prove in court what I'm doing is illegal, immoral or unethical.
Barring that - shove it up your jumper.

re scenes 325pm - Leftwing thesis: an impeached president should not pick new SCOTUS justices. Well, President Clinton did, even though he was impeached after his pick of RGB. The point is that in the interval between his pick and impeachment, his character did not degrade while in office. He was already a sleazebag from the gitgo, and it just took a bit longer to nail him.

;-)

Bill Tozer

Murkowski will listen to what the nominee has to say. Fair enough.

Romney on board to hear the nominee after Mitt was flooded with “a precedent” containing various examples to choose from. He wanted the Constitution (rule of law) and a precedent. He found both:

“It [my decision] is based on the immutable fairness of following the law, which in this case is the Constitution and precedent.

If the nominee reaches the Senate floor, I intend to vote based upon their qualifications.“.

Pretty cut and dry. The Constitution lays it out. Precedent lays it out. One of the two worse decisions IKE’ made as President, according the the man himself, was filing the vacancy on the court with a recess appointment. Judge William Brennan. Became Chief Justice.

Exit Question. Do we even have a nominee yet? I hope she is a hottie!

Minkowski on board to hear the nominee.

Exit Question #2
Long long until they put Jeff Flake in front of the cameras again? They are running out of Republicans in the Senate willing to trash Trump.

Nancy was wrong about having arrows in her quiver. First, she has no say in the Senate or the Senate rules. I believe Face Slide Crazy Nancy is a member of the House of Representatives last I looked. Second, we have clear instructions from the Constitution as well as precedent if you must

On this one issue of appointing nominees and confirming them, Nancy has no arrows in her quiver.
