PaulE 320pm - This doesn't work for me, nor would the Electoral Count Act pass constitutional muster since it seeks to make the certification a foregone process, i.e. a kabuki dance, of government doings which our Constitution does not countenance. Were SCOTUS to rule on it today, it would be struck down. The 1877 law was desperate measure passed at a desperate time for our country trying to sort out the aftermath politics of Reconstruction while wanting not to cause another 'civil war'.

Well he was Pence's lawyer at the time and he gave him the opinion that it would not be constitutional to not certify the election. So you are saying then that Pence could have stopped the certification and Trump would have continued as President till things were sorted out. Do you feel there was good cause to do that?
