Wow

Gregory is reverting to death wishes. Take a break Gregory, we're only engaging in conversation you know. I personally wish you a long life of good health.

George Rebane

Gregory 1244pm - Well yes, but such constitutional crises come very seldom (like now); however, classification changes occur constantly. Hence, the protocol.

Bottom line, IMHO if ONLY the president retains ONLY fond memories of having declassified something, then that modus operandi lays former and serving presidents open to vindictive political hack jobs like the one going on right now. I'm not opining here on the legality of such sub-rosa declassifications, only on their vulnerability to bad actor enemies.

Paul Emery

So George should the press and curious citizens have access to the, in Trumps view, former top secret documents?

George Rebane

PaulE 153pm - You already asked this and I answered. No memory, no conversation.

Paul Emery

I must have missed your response George. I do recall you stating that it is an interesting question. I'll take al look back and find it. I'm sure it's on this post.

Paul Emery

George

Was this the response you referred to concerning public access to the declassified files?

T"he FOIA issue concerning access to formerly classified, now sub-rosa presidentially declassified federal documents, is a valid concern, and a good point to discuss. We can all think of reasons why some such documents, subsequently released through FOIA, would not serve the national interest. My own recommendation of using a more formal procedure for presidential declassification was offered to avoid the current problems of sub-rosa disposition of classified documents."

George Rebane

PaulE 245pm - Yes.

Thanks George

I missed it first time around.

“Thanks George

I missed it first time around.”

I call bull shit. What a complete waste of time and energy. Again! Paul Emery did not miss it the first time around. He badgered readers to agree or disagree with George Rebane’s desired protocols for hours. That is how much he missed it the first time around.

I call double Bull Shit. Gregory said it best.

Well thats succinct -

This was an unprecedented, unnecessary, unlawful home raid on a former president. The whole legal basis for the raid has been blown apart. They went after Trump, they say he may have violated the Espionage Act. That’s not even possible as the commander in chief he can declassify anything he wants. They say he may have stolen or misused government property under the Presidential Records Act and other statutes.

That’s just not possible. There’s a 2012 decision by an Obama judge that former presidents can take personal records with them when they leave office. So there goes the obstruction allegations. It’s legally impossible to obstruct non-crimes like they’re trying to investigate here. There’s a track record of lying in this case. They leaked out that Attorney General Merrick Garland did not personally approve this raid. That’s a lie. They leaked out that Trump had nuclear documents at Mar-a-Lago. That’s a lie. They leaked out that president Biden and the Biden White House was not — did not have a heads-up about this raid. That’s a lie.

The FBI did not raid Mar-a-Lago to get classified documents. They raided Mar-a-Largo to get unclassified Crossfire Hurricane documents back and deep six them forever.

It is a long read and not for the faint of heart, but it’s a pretty solid argument. I wouldn’t be surprised if the magistrate appointed special master. DOJ is behaving very inappropriately leaking to the media and putting unrelated information into pleadings. It is a bad look and won’t be taken kindly to by the magistrate. The behavior is pretty egregious. Airing unrelated dirty laundry in pleadings is not usually a good idea.

While Judge Cannon’s stay and order to have a untainted special master’s review items seized at Mar-a-Lago for executive privilege and attorney client privilege is being fought tooth and nail by the DOJ and is complicated, I found one section in the article of upmost interest.

First, the article:

‘Biden’s DOJ Doesn’t Want To Disclose ‘Classified’ Mar-A-Lago Documents—Except Through Selective Leaks To Leftist Media’
https://thefederalist.com/2022/09/12/bidens-doj-doesnt-want-to-disclose-classified-mar-a-lago-documents-except-through-selective-leaks-to-leftist-media/

Now the section of interest:

‘Full Tilt to Target Trump Before Midterms’

“The argument and analysis presented in the government’s motion reveals another reality: The Biden administration intends to pursue a criminal case against Trump, likely before the 2022 midterms. After the first wave of shock over the raid of the former president’s home passed, the conversation quickly turned to the end goal. Would the government be content with retrieving the documents, or was the government intent on indicting Trump?

While not conclusive, the government’s motion strongly suggests the Biden administration is all-in on pursuing a criminal case against the former president. Every word of the DOJ’s motion frames the case as representing a serious affront to national security and one deserving of criminal penalties.

For example, the Biden administration argues that “without a stay, the government and public also will suffer irreparable harm from the undue delay to the criminal investigation.” “The public has an ‘interest in the fair and expeditious administration of the criminal laws,’” the brief continues, adding that “any delay poses significant concerns in the context of an investigation into the mishandling of classified records.” “The government’s need to proceed apace is particularly heightened where, as here, obstructive acts may impede its investigation,” the Biden administration further stresses.

A few months’ delay to allow the special master to review the documents, however, is far from an “undue delay,” unless the Biden administration’s focus isn’t a “fair and expeditious administration of the criminal laws,” but midterm elections.“

To which reenforces my belief that the media is characterizing the mid-terms of as a bullshit race between Biden and Trump. Punchy would be exhibit A from the media sources he is spoonful.
